Missouri foreclosure is non-judicial — and there is no coming back after the trustee’s sale

Missouri uses a deed-of-trust system. When a borrower falls behind, the lender does not go to court. Under RSMo §§ 443.290–443.420, the trustee publishes notice in a local newspaper once a week for four consecutive weeks, then holds the sale. From first publication to the trustee’s sale typically runs 30–60 days. Total window from first default notice to losing the property: commonly 60–90 days.

There is no right of redemption after the trustee’s sale for most residential mortgages in Missouri. Once the property sells at auction, it transfers. The former owner has no legal path to reclaim it. This differs sharply from Minnesota, where homeowners have a six-month window after the sheriff’s sale, or Wisconsin, where the redemption window runs twelve months from the judgment date. In Missouri, the date on the default letter is the only deadline that matters.

What does the notice of trustee’s sale mean, practically?

The four-week publication must complete before the sale can be held. If you received a notice with a specific sale date, that date is fixed unless the lender agrees to postpone it. If you want to sell before the auction, you need to close before that date — which means starting the process at least two to three weeks prior to allow title work and scheduling.
